Overview

The EU Battery Regulation (2023/1542) establishes comprehensive extended producer responsibility (EPR) for all batteries placed on the EU market. Effective August 18, 2025, battery producers are operationally and financially responsible for end-of-life battery management, including collection, treatment, and recycling. Producers must register in each EU member state where they sell batteries and either manage waste obligations directly or appoint a Producer Responsibility Organisation (PRO). The regulation covers all battery types: portable, automotive, industrial, light means of transport (LMT), and electric vehicle batteries. It fully replaces the previous Battery Directive 2006/66/EC. Non-EU producers must appoint an EPR Authorized Representative in each relevant member state.

Enforcement

Producers who fail to register or meet EPR obligations face enforcement from national environmental authorities in each EU member state. Penalties vary by country but can include fines, sales bans, and criminal prosecution. Due diligence requirements have been delayed by two years from the original timeline.
