Overview

Several U.S. states require retailers to collect a mandatory per-unit recycling fee on mattress and foundation sales. These fees fund the Mattress Recycling Council (MRC) programs that collect and recycle discarded mattresses. Fees must be separately stated on invoices and are not refundable to the consumer.

Enforcement

Retailers who fail to collect mandated mattress recycling fees may face state enforcement actions and fines. Each state program has its own compliance and audit provisions.

What merchants get wrong

State-by-state rates differ significantly—California $10.50, Oregon $22.50—so merchants selling across multiple states cannot use one flat rate. Terminology varies: Rhode Island says "mattresses and box springs," others say "mattresses and foundations"; they generally mean the same thing, but check each state's definitions. California requires the exact label "Recycle Fee $10.50" on invoices; other states are less strict. Minnesota passed legislation in 2021 but the program is not yet active—don't collect a fee there until the MRC finalizes it.
