Payment Surcharges in the Netherlands: PSD2 Card Ban, PayPal and Klarna Permitted

Under EU PSD2 and the Interchange Fee Regulation, merchants in the Netherlands cannot add surcharges on card-based payments (debit and credit cards). Surcharges on PayPal, Klarna, and other payment methods not covered by the card surcharge ban are not prohibited at EU level; merchants may add them with clear disclosure where permitted by Dutch consumer law.

Overview

EU law (PSD2 Article 62(4) and the Interchange Fee Regulation) prohibits surcharges on card-based payments where both the consumer's and the merchant's payment service providers are in the EEA. This covers the vast majority of card payments in the Netherlands. Surcharges on Visa, Mastercard, and other regulated card schemes cannot be passed to the consumer. Payment methods such as PayPal, Klarna, and other buy-now-pay-later or wallet services are not within the scope of the card surcharge ban; member states may allow or restrict surcharging on these. In practice, Dutch merchants generally do not surcharge for alternative payment methods either. Merchants selling to Dutch consumers must not add fees for card payments.
